This Acceptable Use Policy (“AUP”) forms part of the Pixiera Terms of Service.
It describes prohibited uses of Pixiera and is intended to protect Pixiera, its customers, third parties, connected platforms, and the integrity of the Services.
1. GENERAL RULE
You may use Pixiera only for lawful, authorized, legitimate, and intended business purposes.
You are responsible for your use of the Services and all activity conducted through your Account.
2. PROHIBITED USES
You must not use Pixiera to:
- violate applicable law;
- commit or facilitate fraud;
- conduct phishing;
- impersonate another person or organization unlawfully;
- distribute malware;
- obtain unauthorized access;
- bypass authentication or security controls;
- circumvent Subscription, user, credit, or usage limits;
- interfere with Service availability or performance;
- conduct unauthorized scraping or harvesting;
- misuse Third-Party Services;
- violate privacy or data-protection rights;
- infringe intellectual property rights;
- send unlawful unsolicited communications;
- create fake reviews;
- fabricate testimonials;
- fabricate customer experiences;
- knowingly create materially deceptive marketing content;
- unlawfully manipulate ratings or reviews;
- abuse automated workflows;
- execute unlawful campaigns;
- misuse AI functionality;
- facilitate unlawful activity; or
- create unreasonable security, legal, operational, or reputational risk for Pixiera or third parties.
3. REVIEWS AND CUSTOMER FEEDBACK
Customer must not use Pixiera to:
- fabricate reviews;
- impersonate reviewers;
- create fake customer experiences;
- manufacture false testimonials;
- manipulate ratings dishonestly;
- create misleading customer feedback;
- suppress legitimate negative reviews through unlawful means; or
- otherwise mislead the public about customer feedback.
Pixiera does not authorize the use of AI to manufacture customer experiences that did not occur.
4. COMMUNICATIONS AND MARKETING
Customer is responsible for complying with applicable laws concerning:
- email marketing;
- SMS;
- messaging;
- direct marketing;
- consent;
- unsubscribe requirements;
- customer communications;
- promotional offers;
- advertising disclosures; and
- communications to customers, leads, or prospects.
Pixiera does not guarantee that use of a communications feature itself establishes legal compliance.
5. AI MISUSE
You must not use Pixiera AI functionality to:
- facilitate fraud;
- impersonate individuals unlawfully;
- intentionally create false evidence;
- knowingly generate deceptive factual claims;
- evade legal or platform safeguards;
- facilitate unlawful harassment;
- generate unlawful deceptive content;
- misuse third-party platforms; or
- intentionally misuse AI systems in a manner that creates material harm.
6. SECURITY ABUSE
You must not:
- attempt unauthorized security testing;
- scan Pixiera systems without authorization;
- interfere with infrastructure;
- introduce malicious code;
- exfiltrate information;
- exploit vulnerabilities for unauthorized purposes;
- access information belonging to another user;
- attempt to defeat rate limits or security protections; or
- use Pixiera infrastructure as a platform to attack third parties.
7. THIRD-PARTY PLATFORM ABUSE
You must comply with the terms, policies, and rules of any Third-Party Service connected to Pixiera.
You must not use Pixiera to:
- circumvent platform enforcement;
- violate API restrictions;
- abuse rate limits;
- distribute prohibited material;
- create unauthorized accounts;
- manipulate rankings unlawfully; or
- otherwise misuse connected platforms.
8. ENFORCEMENT
Pixiera may investigate suspected violations of this AUP.
Where reasonably necessary, Pixiera may:
- request corrective action;
- restrict functionality;
- suspend or revoke an integration;
- suspend an Account;
- remove prohibited content;
- prevent execution of an automated action; or
- terminate access.
Where reasonably practicable and consistent with security and legal requirements, Pixiera will provide notice and an opportunity to remedy a violation.
Pixiera may take immediate action where necessary to protect users, systems, third parties, or comply with law.
9. REPORTING ABUSE
Suspected violations may be reported to:
Reports should include sufficient information for Pixiera to understand the issue.
10. CHANGES
Pixiera may update this AUP as the Services, legal requirements, security risks, or industry practices evolve.
